Lullashelf Terms and Conditions

These Terms and Conditions apply to your use of the Lullashelf iPhone and iPad app, website, support services, storybook import/export features, sharing features, reader audio features, account features, and in-app purchases.

Lullashelf is operated by Four & More Limited, NZBN 9429053619358, New Zealand.

By creating an account, accepting these Terms, downloading the app, using the app, importing or sharing a book, recording narration, or making a purchase, you agree to these Terms.

If you do not agree, do not use Lullashelf.

1. What Lullashelf does

Lullashelf helps families create, import, organise, read, record, export, receive, and share private storybooks.

Current app features include:

• creating books from pasted pages, Photos, Files, folders, and page images
• adding book titles, descriptions, author/creator names, page words, cover choices, and library organisation
• reading books in a full-screen reader
• recording page-by-page narration using the microphone
• exporting combined narration audio
• sharing and receiving .lullashelfbook files
• optional sign-in with Apple or Google through Firebase Authentication
• guest/local use without an account
• recording acceptance of legal terms and privacy policy for signed-in users
• offering book-space packs, an audio-recording unlock, and a full app unlock through Apple StoreKit in-app purchases

3. Account

You can use Lullashelf as a guest on your device. Sign-in is optional unless a feature specifically requires an account.

Guest users must still accept these Terms and the Privacy Policy before using the app. Guest mode does not remove the app rules, purchase terms, content responsibilities, privacy notices, or backup responsibilities in these Terms.

Lullashelf supports Sign in with Apple and Sign in with Google. If you sign in, you are responsible for keeping your Apple, Google, device, and email accounts secure.

You must provide accurate information where the app asks for it. Do not create or use an account for someone else unless you have authority to do so.

Four & More Limited may suspend, restrict, or delete account access where reasonably necessary to protect users, comply with law, prevent misuse, resolve payment issues, or enforce these Terms.

If the app supports account creation or sign-in, Four & More Limited must provide an in-app way to start account deletion before public App Store launch unless Apple confirms an exception applies. Deleting an account may not automatically delete storybooks stored only on your device or in your own iCloud storage; those can usually be deleted directly from the app, device, or iCloud controls.

4. Family and child use

Lullashelf is designed for family storybook use. Children should use the app with a parent, guardian, or responsible adult.

If you add, record, import, or share content about a child, including a child’s name, image, voice, story, or personal details, you must have the right and authority to do so.

You must not use Lullashelf to exploit, harm, bully, harass, identify, shame, or endanger a child or any other person.

5. Your content

Your content includes storybook pages, images, text, titles, descriptions, author/creator names, page words, reader names, audio recordings, book files, and any other material you add, import, record, export, or share.

You keep ownership of your content. Four & More Limited does not claim ownership of your storybook content.

You give Four & More Limited the limited rights needed to provide and support the app features you choose. For the current app, storybook content is stored on your device or in your own iCloud storage when available, rather than on a Four & More Limited story-content backend.

Four & More Limited does not save, host, back up, or maintain a server copy of your storybook pages, book files, page words, narration audio, or library content in the current app. If the only copy of a book is on your device or in your own iCloud storage, you are responsible for keeping that copy safe.

6. Content responsibilities

You are responsible for your content and for how you share it.

You must not create, import, record, export, or share content that:

• infringes copyright, trade marks, privacy rights, publicity rights, moral rights, or other rights
• includes another person’s personal information without authority
• is unlawful, abusive, threatening, harassing, defamatory, hateful, sexually exploitative, or unsafe
• contains malware or harmful code
• misleads people about who created it or who has rights to it
• breaches any applicable platform, school, workplace, family, court, or confidentiality obligation

If someone sends you a .lullashelfbook file, you are responsible for deciding whether to import it and whether you have the right to keep or use it.

7. Sharing books

Lullashelf sharing is a user-directed attachment workflow. When you share a book, the file may include images, page words, metadata, reader names, and audio recordings.

Only share books with people who should receive that content.

Four & More Limited does not control how a recipient stores, forwards, edits, exports, or deletes a file after you send it through Messages, Mail, Files, or another share destination.

Before sharing, you should assume the recipient can keep, copy, edit, or forward the file outside Lullashelf.

8. In-app purchases

Lullashelf may include free book space, paid book-space packs, a limited number of free audio recordings, a paid audio-recording unlock, and a full app unlock.

Payments are processed by Apple through the App Store and StoreKit. Apple’s App Store terms, payment rules, refund rules, family sharing settings, taxes, and purchase controls may apply.

Purchased book-space packs, recording unlocks, and full app unlocks are intended to unlock additional capacity or features in Lullashelf. The full app unlock is intended to include unlimited story/download space, unlimited voice recording, and access to future Lullashelf app features that Four & More Limited includes in that unlock. Purchases do not transfer ownership of the app, source code, brand, or any Four & More Limited intellectual property.

Before paid public launch, Four & More Limited should verify purchase restoration and reinstall behaviour in the production App Store environment. The app can ask StoreKit to restore verified purchases, but public purchase claims should not overpromise restore behaviour until production testing confirms it.

9. Tester access

Some TestFlight, owner, or tester builds may include tester access or unlimited story, download, recording, and feature access. Tester access is for testing and may be changed, removed, or disabled at any time.

Tester access is not a public paid product unless Four & More Limited expressly says so in the App Store listing or purchase flow.

10. App Store and Apple terms

Your download and use of Lullashelf through the App Store is also subject to Apple’s terms and policies.

Unless Four & More Limited provides and applies a custom end-user licence agreement through App Store Connect, Apple’s standard Licensed Application End User License Agreement may apply to the app.

These Terms add app-specific rules for Lullashelf. If there is a conflict between these Terms and Apple’s mandatory App Store terms for app distribution, Apple’s mandatory terms may apply to that extent.

Apple is not responsible for Lullashelf content, support, maintenance, claims, or warranties except to the extent Apple’s own terms or applicable law require otherwise.

11. Licence to use Lullashelf

Four & More Limited grants you a personal, limited, revocable, non-exclusive, non-transferable licence to use Lullashelf for lawful personal and family storybook creation, reading, recording, organisation, import, export, and sharing.

You must not:

• copy, modify, reverse engineer, or attempt to extract Lullashelf source code except where law allows
• sell, rent, sublicence, or commercially exploit the app without written permission
• interfere with app security, purchase systems, authentication systems, or storage systems
• use the app to break the law or breach another person’s rights
• remove or misuse Lullashelf, Four & More Limited, Apple, Google, Firebase, or third-party notices

12. Intellectual property

Lullashelf, the app design, brand, logos, visual assets, code, prompts, templates, website, documentation, and related materials are owned by Four & More Limited or its licensors, except for your content and third-party materials.

You may not use Lullashelf branding or Four & More Limited branding in a way that suggests endorsement, partnership, or ownership without written permission.

13. Third-party services

Lullashelf depends on third-party services and platforms, including Apple, iOS, iCloud, App Store, StoreKit, Sign in with Apple, Google sign-in, Firebase Authentication, and Firestore.

Those services may have their own terms, privacy policies, account rules, outages, limits, fees, and controls. Four & More Limited is not responsible for third-party service failures beyond its reasonable control.

14. Availability and changes

Four & More Limited may change, suspend, limit, or stop Lullashelf features where reasonably necessary, including for maintenance, security, legal compliance, App Store requirements, provider changes, or product changes.

Four & More Limited will try to avoid unnecessary disruption, but Lullashelf is provided as an evolving app and may contain bugs or limitations.

15. Backups and data loss

Lullashelf is designed to store books locally on your device or in your own iCloud storage when available. Lullashelf does not save your books on Four & More Limited servers. You are responsible for maintaining your device, Apple ID, iCloud settings, backups, and shared/exported copies.

Deleting the app, deleting iCloud content, turning off iCloud for the app, changing Apple ID settings, losing access to a device or Apple ID, device failure, storage errors, or software bugs may affect access to books or recordings.

To the maximum extent allowed by law, Four & More Limited is not responsible for lost books, lost recordings, failed backups, failed iCloud sync, deleted local content, or unrecoverable storybook content where the loss was outside its reasonable control.

16. Privacy

The Lullashelf Privacy Policy explains how personal information is handled. By using Lullashelf, you also agree to the Privacy Policy.

17. Consumer rights

Nothing in these Terms limits rights you may have under laws that cannot be excluded, including the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 where they apply.

If you use Lullashelf for business purposes, you agree that, to the extent permitted by law, the Consumer Guarantees Act 1993 does not apply.

18. Disclaimers

Lullashelf is provided on an "as is" and "as available" basis, except where the law requires otherwise.

Four & More Limited does not promise that:

• the app will always be available or error-free
• all imported files will work
• shared files will be delivered by Messages, Mail, Files, iCloud, or other providers
• iCloud or third-party account services will always sync or restore content
• every purchase, backup, export, import, or recording will succeed in every environment

19. Liability

To the maximum extent allowed by law, Four & More Limited is not liable for indirect loss, consequential loss, loss of profits, loss of data, loss of content, loss of opportunity, or third-party service failures.

Where Four & More Limited is legally liable and liability cannot be excluded, its liability is limited to the amount you paid for Lullashelf purchases in the 12 months before the event giving rise to the claim, or NZD $100, whichever is greater, except where the law does not allow that limit.

20. Indemnity

You agree to take responsibility for claims, losses, costs, and expenses arising from your content, your sharing of content, your breach of these Terms, or your infringement of another person’s rights, except to the extent caused by Four & More Limited’s unlawful conduct.

21. Ending use

You may stop using Lullashelf at any time. You may delete local books in the app and delete the app from your device.

You may request deletion of account records held by Four & More Limited by contacting support@lullashelf.com. Some records may be kept where reasonably needed for legal, accounting, security, dispute, or compliance reasons.

The public app should include an in-app account deletion option. The current app can start an account deletion request from Profile; a direct in-app deletion flow would be stronger if Apple expects completion rather than request initiation.

Four & More Limited may end or restrict your use of Lullashelf if you breach these Terms or if continued access would create legal, security, or operational risk.

22. Changes to these Terms

Four & More Limited may update these Terms when Lullashelf changes or when legal, App Store, operational, or provider requirements change.

If a change is material, Lullashelf should update the legal version and request renewed acceptance where appropriate.

23. Governing law

These Terms are governed by New Zealand law.

The courts of New Zealand have non-exclusive jurisdiction, except where mandatory consumer protection laws in your country require otherwise.
